Hello Mr. Wynne:
My name is Linda V. Leyva, founder of Angels To The Rescue Organization.
The reason I am contacting you is because I am investigating a wrongful conviction case against Jose Manuel Lopez who was tried in 2006 in Cameron County.
We are led to believe that former Cameron County District Attorney Armando Villalobos used contaminated DNA evidence and false statements from individuals who had motive and intentions for Mr. Lopez to be convicted and which as a result have kept him incarcerated and scheduled to serve many years in prison. Below are listed some of our conclusions after a cursory investigation into the matter:
The first motive:
DA Villalobos asked Mr Lopez, a famous Tejano singer, to perform at a fundraiser. Mr. Villalobos paid him a down payment but then cancelled the fundraiser a month before the date of the concert and insisted that he return the money disbursed to him at the time of agreement. Mr. Lopez informed Mr. Villalobos that he had spent the money on lights and sound systems for the fundraising and that he didn't have that money any longer. Mr. Lopez also said the contact stated that unless ample time was given to request a refund, the money would not be returned. Mr. Villalobos became very upset and we have evidence that proves that at the time he threatened Mr. Lopez by stating, "I am going to destroy you"!
Second motive:
Mr. Lopez's sister-in law Blanca Lopez divorced his brother Saul Lopez and has always blamed Mr. Lopez for that divorce. Our indications from statements made by the family is that she carries hatred for the Lopez family. During the trial , it was learned that she allowed the victim – a minor – to consume illegal drugs and alcohol at an early age even before she stayed at the Lopez household and would not be above accepting money to further her goals.
Third motive:
The "victim" (Lopez's niece) was dating a young man in Baytown even before she was in Brownsville and she wanted to go see him and when Mr. Lopez refused to give her a ride on his way to perform at a concert, she made false allegations that he had sex with her. She has since the trail, bore a child from him. Note that Mr. Lopez lived not even a block from a police station so the question then becomes: Why didn't she go file a complaint immediately?
Fourth motive:
A rape kit was performed on her and results came back negative on penetration. DA Villalobos asked Blanca Lopez to come up with evidence so she turned in a pair of green shorts four (4) months after the date of the false allegation. That evidence was contaminated and tampered with by both individuals and other members of the family because they were in a plastic bag where dirty laundry was kept. During the trial, Mr. Lopez's defense did not hire an expert to rebut the DNA evidence produced by Mr. Villalobos. In fact, before he left office, he refused to produce the so-called DNA samples and results he used and requested a Texas Attorney General's opinion instead.
A writ of mandamus has been field in the original court, the 357th District Court once headed by Leonel Alejandro, who resigned with a full two years left in his term. Mr. Alejandro has figured prominently in the Abel Limas corruption case as one of those judges "friendly" to the cash-for-favors arrangements Limas had with several prominent attorneys, some of which were (and are) on trial for corruption and racketeering.
Mr. Lopez has Houston appellate attorney Tim Hootman working on his appeal at the moment. Mr. Lopez has been incarcerated for the past 6 years. I am asking for your assistance to right this this injustice done against Mr.Lopez.
Mr. Villalobos has been indicted by your office for racketeering, taking bribes, tax fraud, and of letting a convicted murderer walk free. If the OUSA believes he was capable of committing those acts, we are led to believe that he is also capable of anything to gain a conviction, especially one of a high-profile performer, just to get publicity and revenge. Now the tables have turned on him. I am a true believer in Karma. Please feel free to contact me at your convenience.
